Tylenol Recall Case Moved To FDA Crime Division

Thursday, 27 May 2010

The makers of several different forms of children’s Tylenol are in serious hot water with the government. The string of recalls that may be related to at least 30 deaths is under investigation by the FDA and has now been moved to the crime division. This move indicates there may be potential criminal charges and indictments as a result of the numerous recalls. Deputy Commissioner of the FDA Joshua Sharfstein, restates the danger to consumers was low, while giving his testimony in the congressional hearing.

The hearing follows the latest recall in April that included 40 different liquid medicines designed and marketed for children. This was the 4th recall in seven short months. The FDA is looking into 775 cases that are linked to medicines recalled by McNeil Consumer Healthcare, the maker of children’s Tylenol products and a division of Johnson & Johsnon. FDA inspectors cited the company in April for filthy equipment, bacteria contamination in ingredients and the possibility of medicines being made too potent. These violations were not the first time the company had been cited. However, the FDA claims McNeil generally resolved the issues.

The congressional hearing will look into the oversight on Johnson & Johnson’s part as well as the FDA’s responsibility. Johnson & Johnson’s is defending their actions that included issuing a quick recall and informing consumers about the potential problem. The McNeil plant has been closed by Johnson & Johnson and is reportedly working to correct its mistakes through restructuring of top management and better employee training. tylenol-325
